Rethink
A dud cheque is a cheque that cannot be paid because the person who wrote it has no money
or not enough money in their bank account. In Nigeria the issuance of dud cheques is a
criminal offence under Section 1 of the Dishonoured Cheques (Offences) Act Cap D11 Laws of
the Federation of Nigeria 2004 which is punishable on conviction with a 2 year jail term. The issuance of dud cheques is a financial crime and thus falls under the purview of the Economic
and Financial Crimes Commission (EFCC).
Where a person receives a dud cheque, he may choose to exercise various options such as:
1. Bringing civil action for the value of the instrument;
2. Making official report to the Police and/or EFCC so that criminal proceedings may be instituted.
